NAR Settlement: What It Means for Home Buyers and Sellers

NAR Settlement: What It Means for Home Buyers and Sellers

Understanding the NAR Settlement: What It Means for Home Buyers and Sellers The National Association of REALTORS® (NAR) has announced a landmark settlement that's set to bring changes to the real estate industry. #### The Heart of the Settlement At the core of this settlement is a $418 million agreement intended to address and resolve litigation concerning broker commissions. This resolution highlights a move towards greater transparency and flexibility in real estate transactions, ensuring both buyers and sellers have more control and understanding of the process. ### FAQs on the NAR Settlement #### What does removing the “offer of compensation” field in the MLS mean for me This change means that the specifics of agent compensation will no longer be publicly listed in the MLS, pushing for negotiations to happen directly and enhancing transparency and choice in the process. The commission amount/percentage can be posted on agents websites and other areas, just not on the MLS. #### How will buyer agents get paid now? Buyer agents’ compensation can still come through direct payments from buyers, concessions offered by sellers, or a share of the listing broker's compensation. These arrangements will be explicitly negotiated during the transaction, reflecting the service value. This has not changed and has always been an option. #### Are real estate commissions still negotiable? Absolutely. The settlement reiterates the flexibility in negotiating commission rates, empowering sellers to use this as a strategy to attract potential buyers with various incentives. #### Do I need a written buyer representation agreement now? Yes, starting from July 1, a written agreement with your buyer’s agent becomes mandatory before viewing properties. This is to ensure transparency about the agent’s services and fees. #### How do these changes benefit me? For buyers and sellers alike, these adjustments aim to demystify the real estate transaction process, making it more transparent and equitable. Whether you're looking to purchase a home or sell one, these changes provide more flexibility and informed choice, aligning the process with your specific needs and circumstances. ### Looking Ahead As we navigate these changes together, remember, our goal at Carter Signature Properties is to provide you with a signature experience that simplifies your real estate journey.
